Property Rights: Condemnation and Eminent Domain

When governments or authorized corporations attempt to take private property for projects that destroy communities and the environment, such as pipelines and industrial parks, we represent property owners in insisting that the right to take the property is constitutionally valid. We also work with real estate appraisers in the condemnation process to increase the compensation if the property is ultimately taken by the government. Property rights can also be taken by the creation of a nuisance or by the trespass of pollution created by government activities. Property owners can recover property damages from the government in inverse condemnation actions where property rights have been taken without just compensation.
